Tennessee, the Davy Crockett state, wants to criminalize porn
much the way Utah is doing.
SB1792, brought by Sen. Becky Duncan Massey (R-Knoxville),
is Titled the “Protect Tennessee Minors Act." The bill would make porn
websites criminally liable if they don’t verify the ages of users of their
sites through photo matching.
Part of the bill language says the “reasonable
age-verification method” would include a means to match a photograph of the
active user to their valid form of identification, such as a driver’s license,
or a “commercially reasonable method relying on public or private transactional
data.”
Additionally, the bill would require any website that
provides for the age verification method to keep “anonymized age-verification
data” for at least seven years.
Massey said the way the law would work is the age
verification would be valid for 60 minutes. After that, if a user wasn’t
“actively using” the site, they would be required to leave it.
Violations of the age verification process would be
considered Class C felonies, according to the bill. In Tennessee, Class C
felonies typically carry three to 15 years in prison and fines up to $10,000.
Twenty-seven states now have some form of age
identification.
